"Sec. 2. Title 48, chapter 6, article 4, Arizona Revised Statutes, is amended by adding sections 48-1012.01, 48-1012.02 and 48-1012.03, to read:
48-1012.01. Domestic water improvement district; water standpipe; board of directors; limitations; definition
A. In addition to the purposes for which an improvement district may be formed under section 48-909, a domestic water improvement district may be formed for the limited purposes of constructing, operating and maintaining one or more water standpipes for providing water to be hauled for domestic use by the residents of the district, purchasing water for that use, installing wells and acquiring and maintaining real property for the standpipe and its related IMPROVEMENTS. The district shall provide access to the standpipe for residents of the district or privately operated water haulers for delivery of water to the residents of the district.
B. A district ESTABLISHED pursuant to this section shall be governed by a board of directors as PRESCRIBED in this article. Subject to the limitations prescribed by this section, the powers and duties of the board of directors of the district and those of the county board of supervisors shall be as provided in this chapter for other types of improvement districts.
C. For the purposes of a domestic water improvement district that is formed pursuant to this section, "domestic water delivery system" means one or more standpipes and related IMPROVEMENTS as prescribed in this section.
48-1012.02. Domestic water improvement district; water standpipe; petition; additional parcels
a. A domestic water improvement district formed for the purposes prescribed in section 48-1012.01 may be established in an unincorporated area of the county, whether or not contiguous, by filing a petition as prescribed by section 48-903 except as follows:
1. The petition shall provide the tentative BOUNDARIES of the proposed district and shall include a listing of assessor's parcels that may be included in the district. The tentative boundaries may include parcels owned by persons who do not sign the petition and who do not consent to an assessment.
2. The petition shall be signed by all of the property owners in the proposed district who consent to an assessment for the purposes of the district. A person who does not consent to an assessment may not be assessed by the district.
B. On submittal of a petition to the county board of supervisors, the board may summarily order the formation of the district as prescribed in section 48-902. The district shall consist of all of the parcels whose owners signed the petition. At the discretion of the county board of supervisors, the board may hold a hearing as prescribed by section 48-905.
C. If the tentative boundaries of the proposed district are within six miles of a city or town, the district petitioners shall obtain the consent of the governing body of the city or town. On obtaining consent to the tentative boundaries, additional PARCELS may be added to the district after formation as prescribed by this section without requiring further city or town consent if those additional parcels are within the original tentative boundaries of the proposed district.
D. On petition by the owner of property within the tentative boundaries of A domestic water improvement district formed for the purposes prescribed in section 48-1012.01 that has not PREVIOUSLY consented to assessment by the district and if the board determines that there are adequate water resources for the additional parcel, the board of directors for the district may approve the addition of the parcel. The board may establish criteria and time limits for additions to the district. On approval, the owner of the parcel is liable for assessments, user fees and any costs associated with the addition.
48-1012.03. Domestic water improvement district; water standpipe; assessments
On formation of the district by order of the county board of SUPERVISORS, the district is ESTABLISHED and its board of directors may assess its members that have consented to assessment and their parcels as follows to pay for constructing, operating and maintaining the domestic water delivery system:
1. Assessments as prescribed in section 48-914.
2. User fees as PRESCRIBED in SECTION 48-910, subsection A, including a base fee and fees determined by the quantity of water used."
